The staff is also empowered to ask the owner to register the field intervention agreement. Intervention arrangements are no longer necessary for: light landscaping (ground cover, low shrubs) without irrigation can be installed without permission in priority. But they do so at their own risk and anything planted in the city`s priority right can be removed if it is in conflict with future road or drainage works. Permanent buildings such as the wall, fence, mailbox or decorative buildings are not allowed in the city`s right of priority. In special circumstances and as a last resort, you can apply for an intervention contract for these works, which is contemplated by the City in addition to a containment permit. To the extent that the proposed interventions meet the technical criteria, the officers are responsible for adopting intervention procedures for the authorized interventions described in Communal Order 743, Article IV. 3. Insurance: present a written certificate from the insurance agency stating that it is able to provide the insurance coverage necessary for the intervention in accordance with the terms of the contract. In particular, the owner must own a home and non-life insurance for the property, including the area of intervention, of at least 500,000 USD per incident, which ensure liability in case of property damage and 1,000,000 USD for the injury or death of a person or a single limit of 1,000,000 USD due to location or condition of improvement. Police cite the city of Lafayette as an additional insured.
The owner of the property will waive any right of recovery that he may have against the City because of payments from the owner or his insurer for property damage or injury or death of a person as a result of an act or omission of the city. The owner of the real estate business requires his contractors who are doing work to build the upgrades in order to add the city as an additional insured in the general liability policy of the contractor using form ISO CG 20 38 or exactly equivalent. The owner must provide the city with satisfactory proof of insurance and proof that the carrier is required to notify the city of a notification at least 10 days before the cancellation or reduction of the insurance coverage of the necessary policies.
